Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. secret services) may process, evaluate and permanently store your data on US servers for surveillance purposes. We have no influence on these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can withdraw your consent at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to the collection of data in special cases and to direct marketing (ART. 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ART. 6 ABS. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 GDPR).

IF YOUR PERSONAL DATA ARE PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 PARA. 2 GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, erasure and rectification

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of the data processing and, if necessary, a right to correction or deletion of this data. You can contact us at any time if you have further questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do this. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the review, you have the right to request that the processing of your personal data be restricted.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it for the exercise, defense or assertion of legal claims, you have the right to request the restriction of the processing of your personal data instead of its erasure.
  • If you have lodged an objection in accordance with Art. 21 para. 1 GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

SSL Or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We will not pass on this data without your consent.

This data is processed on the basis of Art. 6 para. 1 lit. b GDPR if your request is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR) if this has been requested; consent can be revoked at any time.

We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Meta Pixel (formerly Facebook Pixel)

This website uses Facebook/Meta visitor action pixels to measure conversion. This service is provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. However, according to Facebook, the data collected is also transferred to the US and other third countries.

This allows the behavior of website visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook advertisement. This allows the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes and future advertising measures to be optimized.

The data collected is anonymous to us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook, so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data usage policy (https://de-de.facebook.com/about/privacy/). This enables Facebook to display advertisements on Facebook pages and outside of Facebook. As the website operator, we have no influence on this use of data.

Advanced matching allows us to transfer various types of data (e.g., place of residence, state, postal code, hashed email addresses, names, gender, date of birth, or phone number) about our customers and prospects that we collect via our website to Meta (Facebook). By activating this feature, we can tailor our advertising campaigns on Facebook even more precisely to people who are interested in our offers. In addition, advanced matching improves the attribution of website conversions and expands custom audiences.

Insofar as personal data is collected on our website with the help of the tool described here and forwarded to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). Joint responsibility is limited exclusively to the collection of data and its transfer to Facebook. The processing by Facebook after the transfer is not part of the joint responsibility. The obligations incumbent upon us jointly have been set out in a joint processing agreement. The wording of the agreement can be found at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing data protection information when using the Facebook tool and for the data protection-compliant implementation of the tool on our website. Facebook is responsible for the data security of Facebook products. You can assert your rights (e.g., requests for information) regarding the data processed by Facebook directly with Facebook. If you assert your rights with us, we are obliged to forward them to Facebook.

Data transfer to the US is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://de-de.facebook.com/help/566994660333381.

By integrating this JavaScript tag, you as a user of our website can be shown interest-based and relevant advertisements (“ads”) when visiting the social network LinkedIn or other websites that also use this process, and we receive statistics about website visitors and demographics. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g., IP address, length of time spent on the website, or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place.

The storage and analysis of the data is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and from SPAM. If consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information on the user’s end device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.

Further information on Google reCAPTCHA can be found in Google’s privacy policy and Google’s terms of use at the following links: https://policies.google.com/privacy?hl=en and https://policies.google.com/terms?hl=en.

Processing customer and contract data

We collect, process, and use personal customer and contract data for the establishment, content, and modification of our contractual relationships. We collect, process, and use personal data relating to the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6 para. 1 lit. b GDPR.

The customer data collected will be deleted after completion of the order or termination of the business relationship and expiry of any statutory retention periods. Statutory retention periods remain unaffected.

9. Our own services

Handling of applicant data

We offer you the opportunity to apply for a position with us (e.g., by email, post, or via our online application form). Below, we provide information about the scope, purpose, and use of your personal data collected during the application process. We assure you that your data will be collected, processed, and used in accordance with applicable data protection laws and all other legal provisions, and that your data will be treated as strictly confidential.

Scope and purpose of data collection

If you send us an application, we will process your associated personal data (e.g., contact and communication data, application documents, notes made during job interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) (initiation of an employment relationship), Article 6(1)(b) of the GDPR (general contract initiation) and, if you have given your consent, Article 6(1)(a) of the GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If your application is successful, the data you submit will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6 (1) lit. b GDPR for the purpose of implementing the employment relationship.

Data retention period

If we are unable to offer you a position, you decline a job offer, or withdraw your application, we reserve the right to store the data you have provided on the basis of our legitimate interests (Art. 6 (1) (f) GDPR) for up to six months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The storage serves in particular for verification purposes in the event of a legal dispute. If it is apparent that the data will be required after the expiry of the 6-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we do not make you an offer of employment, we may include you in our applicant pool. If you are included in the applicant pool, all documents and information from your application will be transferred to the applicant pool so that we can contact you if a suitable vacancy arises.

Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 (1) lit. a GDPR). The provision of consent is voluntary and is not related to the current application process. The data subject may revoke their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, unless there are legal reasons for retention.

The data from the applicant pool will be irrevocably deleted no later than two years after consent is given.

Our social media presence

This privacy policy applies to the following social media sites

Data processing by our networks

We maintain publicly accessible profiles on social networks. The specific social networks we use are listed below.

Social networks such as Facebook, Twitter, etc. can generally analyze your user behavior in detail when you visit their website or a website with integrated social media content (e.g., like buttons or advertising banners).

Visiting our social media sites triggers numerous data processing operations that are relevant to data protection. Specifically:

If you are logged into your social media account and visit our social media site, the operator of the social media portal can associate this visit with your user account. However, your personal data may also be collected even if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies stored on your device or by recording your IP address.

With the help of the data collected in this way, the operators of social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you both within and outside the respective social media presence. If you have an account with the respective social network, interest-based advertising can be displayed on all devices on which you are logged in or have been logged in.

Please also note that we cannot track all processing operations on social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. For details, please refer to the terms of use and privacy policies of the respective social media portals.

Legal basis

Our social media presence is intended to ensure the most comprehensive presence possible on the Internet. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. The analysis processes initiated by the social networks may be based on different legal bases, which must be specified by the operators of the social networks (e.g., consent within the meaning of Art. 6 para. 1 lit. a GDPR).

Responsible party and assertion of rights

When you visit one of our social media sites (e.g., Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during your visit. You can assert your rights (information, correction, deletion, restriction of processing, data portability, and complaint) both against us and against the operator of the respective social media portal (e.g., against Facebook).

Please note that despite our joint responsibility with the social media portal operators, we do not have complete control over the data processing operations of the social media portals. Our options are largely determined by the company policy of the respective provider.

Storage period

The data collected directly by us via our social media presence will be deleted from our systems as soon as you request us to do so, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal provisions – in particular retention periods – remain unaffected.

We have no influence on the storage period of your data stored by social network operators for their own purposes. For details, please contact the social network operators directly (e.g., in their privacy policy, see below).

Your rights

You have the right to obtain information about the origin, recipient, and purpose of your stored personal data at any time and free of charge. You also have the right to object, to data portability, and to lodge a complaint with the competent supervisory authority. Furthermore, you may request the correction, blocking, deletion, and, under certain circumstances, the restriction of the processing of your personal data.
